activity or any change in a previously authorized activity. 
May I draw  your attention  to the fact that  the former members of the
Barroso I Commission are bound by the Code of Conduct for Commissioners
adopted in November 2004 (document SEC(2004) 1487/2). This code foresees
that Commissioners shall inform the Commission whenever they intend to
engage in an occupation during the year after they have ceased to hold
office. This one-year period ended on 9 February 2011

The purpose of Regulation 1049/2001 is to give access to the documents to the public at large.

A document disclosed to an individual under this Regulation then became disclosable to any other member of the public (legal or natural person) whenever there is a subsequent request.

This interpretation has been confirmed by the Court of First Instance in its Judgment of 26 April 2005 (Sison v Council) and by the Court of Justice in its Judgment of 1 February 2007 (C-266/05 P).

In accordance to p. 165 of Judgment of the Civil Service Tribunal of 2 May 2007 in Case F-23/05:

“it has to be recognized that a culture of accountability has grown up within the Community institutions, responding in particular to the concern of the public to be informed and assured that malfunctions (...) are identified and, as appropriate, duly eliminated and punished. The consequence of that requirement is that officials and other servants who hold posts of responsibility within an administration such as the Commission must take into account the possible existence of a justified need to communicate a degree of information to the public".

My email to you dated 24 October was aimed at alerting you to the fact that the Commission had posted replies to requests 5105 (and later 5106, 5108 and 5109) under request 5096.
