Group of Personalities on the Preparatory Action for CSDP-related research

Waiting for an internal review by Internal Market, Industry, Entrepreneurship and SMEs of their handling of this request.

Dear Internal Market, Industry, Entrepreneurship and SMEs,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting all documents relating to the Group of Personalities on the Preparatory Action for CSDP-related research. This should include, as a minimum, the following documents:
- the mandate and expected duration of this Group of Personalities
- The dates and location of the meetings of the above-referred Group of Personalities
- The minutes of the meetings of the above-referred Group of Personalities
- The names of people in attendance at the meetings of the above-referred Group of Personalities, and who they represent.

Dear Mr Alexis,

Thank you for your reply dated 8 of June and the attached documents. However we consider that the documents received are not complete.
Indeed the first minutes only give indications about who took the floor during the meeting but not who attended it. In the minutes of the second meeting, a part of the text is missing (2nd paragraph under point 2, “strategic autonomy is a ...[blank]”).
Moreover, the minutes refer to ToRs and to other meetings: a possible GoP meeting before June 2015, and more importantly the GoP's sherpas meetings (“5-6 meetings of the sherpas are foreseen, more if necessary”) as well as discussion papers produced by the sherpas for the GoP formal meetings. As the sherpas were representing the GoP members and were conducting the work for the final report of the GoP, we consider that our request for documents on the GoP covers the work of the GoP sherpas.

Therefore we are requesting for the following complementary information and documents:
- list of participants in the 1st meeting of the GoP (30/03/2015)
- complete minutes of the 2nd meeting (17/11/2015)
- confirmation that there was no other GoP meeting before the June 2015 Council, or if there was one, the attendance list and minutes of this meeting
- the dates of all the meetings of the sherpas, be it in plenary or in sub-groups
- the attendance lists and the minutes of all sherpas' meetings, both in plenary and sub-groups formats
- all the discussion papers and other documents produced by the sherpas for the GoP members and formal meetings
- draft versions of the GoP report if any, as well as any other documents produced by the GoP
- the Terms of Reference mentioned in the minutes of the GoP

I am writing to request an internal review of Internal Market, Industry, Entrepreneurship and SMEs's handling of my FOI request 'Group of Personalities on the Preparatory Action for CSDP-related research'.
Indeed I consider that my request is not undermining public interest in defence and military matters, and that at least part of the requested documents could have been released. For example communicating the dates of the sherpas meetings and the precise lists of participants to each meeting cannot undermine public interest in any way, as the general list of the members of the GoP is already public. However I consider important to know who exacly attended each of those meetings in terms of transparency of the EU decision-making process.
Moreover, I contest the fact that the current decision-making process (about the Preparatory Action on defence research) is being carried out "free of external pressure" and that my request would endanger this independance: indeed the majority of the members of this GoP are representing arms-related industry and application-oriented research groups, which are thus also external stakeholders as much as civil society or an EU citizen can be.

Therefore I disagree with the rejection of my request
