We refer to your email of 7 November 2024 in which you make a request for access to
documents, registered on 8 November 2024 under the above-mentioned reference number.
We also refer to our email of 28 November 2024 extending the time limit to respond to
your request according to Article 7(3) of Regulation (EC) No 1049/2001 (1).
1. Scope of your request
In your request, you ask on the basis of Regulation (EC) No 1049/2001, access to
“documents which contain the following information:

que de ella dependa con información o que trate sobre las mujeres europeas que
viajan a un país distinto al suyo para acceder al aborto.”.
2. No documents held
We regret to inform you that DG SANTE does not hold any documents that would
correspond to the description given in your application. As specified in Article 2(3) of
Regulation (EC) No 1049/2001, the right of access as defined in that regulation applies
only to existing documents in the possession of the institution.
Given that DG SANTE holds no such documents, corresponding to the description given
in your application, we are not in a position to fulfil your request.

In the field of cross-border healthcare within the EU, two legal instruments co-exist and
provide for citizens’ rights to receive healthcare abroad: Regulations (EC) No 883/2004
and 987/2009 on the coordination of social security systems and Directive 2011/24/EU on
the application of patients' rights in cross-border. For more thorough information on your
patient’s rights to accessing healthcare in any EU/EEA country you can consult
the Manual
for Patients published by the Commission. Furthermore, the Commission strongly
recommends patients to always consult
the national contact points, before travelling
abroad, to collate information on the anticipated costs, reimbursement rates, applicable
procedures, time limits and necessary documents to be provided to request the
reimbursement.
3. Means of redress
In accordance with Article 7(2) of Regulation (EC) No 1049/2001, you are entitled to make
a confirmatory application requesting the Commission to review this position.
Such a confirmatory application should be addressed to the Secretariat-General of the
Commission within 15 working days upon receipt of this letter. You can submit it in one of
