Dear Ms Costa,
We are referring to your request for public access below submitted, to the EEAS and registered under reference 2025/032.
Your request is particularly broad and does not seem to be targeted to specific documents. We wish to clarify that requests for access to documents under Regulation 1049/2001 shall be targeted to specific documents of the institution that can be clearly identified. Requests should also be limited in their scope and proportionate. Your request relates to a high number of subject matters for which the EEAS would be supposed to search and assess documents.
We therefore kindly invite you to clarify and limit the scope of your request in line with Articles 6(2) and 6(3) of the Regulation.
Yours sincerely,
EEAS ACCESS TO DOCUMENTS

Dear Ms Costa,
Unfortunately, the list of documents that you have provided in your reply
does not change the disproportionate nature of your request, which relates
to a very high number of documents, also taking into consideration the
absence of any targeted timeframe in your request.
As a fair solution on the limitation of the scope of your request, in line
with the opportunity provided by Article 6(3) of the Regulation, we would
propose that you limit the scope of your request to a maximum number of
three indents from the list of documents provided in your email of 19
March and that you clarify the temporal scope of the request, meaning the
years of issue for the documents that you are interested in.
We consider that this solution would effectively balance your interest in
receiving a reply to your request within the deadlines provided by
Regulation 1049/2001 on one hand, and the administrative burden imposed on
the institution in light of the broad request on the other.
We count on your cooperation and understanding with a view of reaching an
agreement as soon as possible. Please be informed that, as a last resort
in case an agreement cannot be found, the case-law of the Court of Justice
of the European Union allows the institution to take an unilateral
decision on restricting the scope of a request for access to documents
(Judgment of 15 March 2023, [1]T-597/21, Basaglia v European Commission)
subject to conditions that are applicable in the present case (i.e. an
unreasonable workload involved by the search and concrete review of the
high number of documents requested, the different nature of the documents
and diversity of their authors and the institution’s attempt to consult
with the applicant to find alternative solutions).
We are looking forward to hearing from you and we remain at your disposal
in case of any questions you may have.
Yours sincerely,
EEAS ACCESS TO DOCUMENTS
