Infringement case NL Promotion of clean and energy-efficient road transport vehicles
Dear Madam, Sir,
Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:
All documents related to the infringement case INFR(2021)0477 (Lack of transposition by the Netherlands of Directive (EU) 2019/1161 amending Dir. 2009/33/EC - Promotion of clean and energy-efficient road transport vehicles)
Since the case has been closed on 9 February 2022 article 4.2 of Regulation 1049/2001 does not apply here. Even if it were to be argued that it does, there is an overriding public interest, because of the importance of correct and swift transposition of the directive. The directive itself highlights in the preamble what the public interest is:
"Setting minimum procurement targets can effectively help to reach the objective of promoting and stimulating the market uptake of clean vehicles in comparison to relying on the internalisation of external cost into overall procurement decisions, while noting the relevance of considering environmental aspects in all procurement decisions."
"Action carried out under this Directive will contribute to compliance with the requirements of the standards laid down in Regulation (EU) 2019/631."
