I am filing the following confirmatory application with regards to my access to documents request 'JORA Variables 2023-2025'.

I am submitting this confirmatory application pursuant to Article 7(2) of Regulation (EC) No 1049/2001 regarding my initial request (PAD-2025-00184) for access to: “All JORA variables between 1 January 2023 and 30 April 2025.”


In your initial reply, access to data between 26 January 2024 – 30 April 2025 was refused based on Article 4(1)(a) first indent of Regulation (EC) No 1049/2001, citing risks to public security, ongoing evaluations, and the sensitivity of operational content. Access to documents covering the period 1 January 2023 – 25 January 2024 was also denied on the basis that no new facts or legal developments had occurred since similar previous requests (PAD-2024-00023 / PAD-2024-00257).

I would like to respectfully challenge this position and request a reassessment for the following reasons:


1. Regarding the period 1 January 2023 – 25 January 2024:
You concluded that no substantial change has occurred since my earlier applications. However, I submit that the operational period associated with this timeframe now appears to have concluded. This marks a significant factual change that should permit reassessment of the applicable exceptions under Article 4(1)(a).

Moreover, similar or identical JORA data – pertaining to past years and operational periods – has been released multiple times under comparable circumstances. The precedent for disclosing operationally concluded data reinforces the case for revisiting the access refusal.


2. Regarding the period 26 January 2024 – 30 April 2025:
I understand the sensitivity associated with ongoing operations and the need to protect public security. However, I would kindly request that the institution closely monitor the status of the related operational evaluations and reassess the feasibility of at least partial disclosure after the conclusion of the evaluation phase (anticipated late Q2 / early Q3 2025, per your note). I reserve the right to submit a renewed request at that time.


Additionally, I contest the general assertion that partial release is “disproportionate.” Even redacted versions of JORA variables – especially with headers or metadata preserved – can offer transparency without compromising operational sensitivity.


In conclusion, I respectfully request:


A reassessment of access to JORA data from 1 January 2023 – 25 January 2024 in light of the apparent end of the relevant operational period.


A commitment to reassess post-25 January 2024 data upon conclusion of the evaluation phase.
Consideration of partial disclosure, including metadata or anonymized aggregate information, which may mitigate public security concerns.
