Dear Madam, Sir,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

- The letter sent by the European Commission to the former European Commissioner Neelie Kroes, about media reports on her work for Uber. (previously requested under request registered as GESTDEM 2022/3988).
- The letter received by the European Commission from the former European Commissioner Neelie Kroes, about media reports on her work for Uber. This letter was received in July 2022. (previously requested under request registered as GESTDEM 2022/4237)

In its reply on 25 August 2022, the Commission "confirms that an exchange of letters with the former Member of the Commission has taken place", but said that it was "unfortunately not possible to grant access to these documents at this stage".

Since the investigation conducted by OLAF in this case has now been concluded, and the former Commissioner has, according to a press release she has sent to press, been cleared of any wrongdoing, there is no reason to keep these documents confidential.

Please note I prefer to receive the documents in digital format, not by physical mail.

I am filing the following confirmatory application with regards to my access to documents request case number 2024/0100.

As I have said in the initial application: Since the investigation conducted by OLAF in this case has now been concluded, and the former Commissioner has, according to a press release she has sent to press, been cleared of any wrongdoing, there is no reason to keep these documents confidential.

I do not see how these documents could negatively affect Mrs Kroes' integrity, given that OLAF has cleared her of wrongdoing. The arguments given by Mrs Kroes regarding the different levels of press attention given to the opening and the closing of the OLAF case, are irrelevant, and should not be included in the assessment of whether the documents can be published now.
