Dear Madam, Sir,
Thanks for your reply and request for clarification.
On 20 October 2023, press publication Euractiv published an article [1] in which it reported about "a three-page letter, which was sent to von der Leyen’s office on Friday (20 October)". This letter was supposedly signed (or supported) by 850 staff members.
Euractiv quotes from the letter:
"We, a group of EU Commission and other EU institutions’ staff solemnly condemn on personal grounds the terrorist attacks perpetrated by Hamas against helpless civilians (…). We equally strongly condemn the disproportionate reaction by the Israeli government against the 2.3 million Palestinian civilians trapped in the Gaza Strip. [..] Precisely because of these atrocities, we are surprised by the stance the European Commission has taken – and even other EU institutions – promoting what has been described in the press as European cacophony."
I believe that this information should allow the Commission to identify at least this letter.
(Although I am a bit surprised that my initial request, which included a limited period (namely "since 7 October 2023") did not already contain sufficient information to identify at least the quoted letter.)
Sincerely
Peter Teffer

Dear Madam, Sir.
Please pass this on to the person who reviews confirmatory applications.
I am filing the following confirmatory application with regards to my access to documents request registered on 23/10/2023 under case number EASE 2023/6236.
I believe not all documents falling under the scope of my request have been identified. Crucially, it seems the Commission failed to identify the actual letter to which I referred in my request and clarification.
The only document released is an email from the Delegation of the EU to Egypt, which refers to other documents that have also not been identified or released, including:
1) the MyIntracomm "message to staff concerning events in the Middle East" from the President
2) Any reply to the e-mail sent on 24 October and the reminder sent on 20 November
Sincerely

Dear Madam, Sir,
I confirm receipt of your e-mail sent on 12 December 2024.
However, I cannot confirm having received a reply to this new initial request EASE 2024/6052, which the Commission said it would register ex officio.
The decision letter announcing this new request was dated 13 November 2023. Since then, more than 15 working days have passed. The DG responsible therefore should have already sent me a reply. It has not.
I also have not received any message about a need to delay. So when did the responsible DG register this new initial request EASE 2024/6052? And why have I not yet received the reply?
best
Peter

Dear Madam, Sir,
Please pass this on to the person who reviews confirmatory applications.
I am filing the following confirmatory application with regards to my access to documents request. After my complaint to the European Ombudsman (registered by them as case 795/2024/TM) the Commission has registered a new initial request (EASE 2024/6052,) which the Commission said it would register ex officio.
The Commission registered this on 13 November 2024 . On 7 January 2025, after more than 2 x 15 working days had passed, the Commission informed me it was not able to reply within the statutory time limit. Article 7.4 of Regulation 1049/2001 states: "Failure by the institution to reply within the prescribed time-limit shall entitle the applicant to make a confirmatory application."
While I am utterly disappointed to have to make this procedural step once again, I see no other option.
Sincerely,
Peter Teffer
