Thank you for your message regarding your request with reference number: Getsdem 2015/3176.

Your application is currently being handled. However, we were not be in a position to complete the handling of your application within the time limit of 15 working days, which expires today.
An extended time limit is needed as your application concerns documents held by different Services that must be consulted. We are currently in contact with DG GROW (ex-ENTR) who seems to have been at the time (2002) leading on the regulatory cooperation in question. Please also note that if the list that you have requested does not exist and can therefore not be identified under the Regulation 1049/2001, we will be compiling it for you under the Good Administrative Conduct.

Therefore, we have to extend the time limit with 15 working days in accordance with Article 7(3) of Regulation (EC) No 1049/2001 regarding public access to documents. The new time limit expires on 28/07/2015.

We apologise for this delay and for any inconvenience this may cause.

I am writing to request an internal review of DG Trade's handling of my FOI request 'List of "early warning items", EU-US regulatory cooperation', GestDem 2015/3176.

In the request, I asked for "a complete list of "early warning items" between the EU and the U.S. since "The Joint U.S.-EU Statement on Early Warning and Problem Prevention Principles and Mechanisms", adopted at the Bonn Summit in June 1999, including items following the adoption in 2002 of the "Guidelines on Regulatory Cooperation and Transparency" (2002) to date."

As can be seen from the correspondance, I was notified at an early stage that no such document existed, but that it would be compiled, pending responses from other Directorate Generals. After about four months, I received the rejection - referring merely to the fact that no such document exists, which I was aware of, of course.

It seems untrustworthy to me, that after asking for material from other DGs for months (which is what DG Trade says it has done), the end result is nothing. Also, the final letter provides no explanation.

In this case, by the way, both DG Trade and other DGs and me, would avoid wasting a lot of time, if the list is produced and provided. I am perfectly capable of compiling such a list myself, but I would then first have to ask for a considerable amount of documents, from DG Trade as well as other DGs.

I therefore ask DG Trade to reconsider the matter.
