Dear Ms Eberhardt, 
We  refer  to  your  e-mail  of  08/01/2025  in  which  you  made  a  request  for  access  to 
documents, registered on 09/01/2025 under the above-mentioned reference number and to 
your emails of 18/02/2025 and 20/02/2025 clarifying your request. 
Your initial request access concerns: 
“[…] Under the right of access to documents in the EU treaties, as developed in Regulation 
1049/2001,  I  am  requesting  all  documentation  (including  but  not  limited  to  all  email 
correspondence,  attendance  lists,  agendas,  background  papers,  transcripts  and 
recordings) AND the meeting minutes/notes relating to the meeting(s) of Eleonora Ocello 
and Thierry Breton with Kohlberg Kravis Roberts and EQT on 4 December 2023.” 
With the following clarifications: 
“I  would  appreciate  if  you  could  apply  my  request  to  the  roundtable,  so  send  me  all 
documentation  (including  but  not  limited  to  all  email  correspondence,  attendance  lists, 
agendas, background papers, transcripts and recordings) AND the meeting minutes/notes 
relating to the roundtable.” 
 
“I am mainly interested in the lobby contacts of KKR and EQT, but imagine that it could 
make sense to have context to make sense of the relevant information, so I would like to 
request: 
* minutes and other reports of the full roundtable 
* internal Commission briefing for the roundtable in full

* any surrounding communication only with KKR and EQT (not other participants of the 
roundtable).” 
 
We  regret  to  inform  you  that  the  Directorate-General  for  Internal  Market,  Industry, 
Entrepreneurship  and  SMEs  (DG  GROW)  does  not  hold  any  documents  that  would 
correspond to the description given in your application. 
As it was explained to you, the meeting on December 4th 2023 was a roundtable event on 
investment in digital and telecom infrastructures which was not organised by DG GROW. 
As  specified  in  Article  2(3)  of  Regulation  (EC)  No  1049/2001,  the  right  of  access  as 
defined  in  that  regulation  applies  only  to  existing  documents  in  the  possession  of  the 
institution.  
Given that no such documents, corresponding to the description given in your application, 
are held by DG GROW, DG GROW is not in a position to fulfil your request.  
In accordance with Article 7(2) of Regulation (EC) No 1049/2001, you are entitled to make 
a confirmatory application requesting the Commission to review this position.  
Such  a  confirmatory  application  should  be  addressed  to  the  Secretariat-General  of  the 
Commission within 15 working days upon receipt of this letter. You can submit it in one 
of the following ways:  
by  asking  for  a  review  via  your  portal  account  (available  only  for  initial  requests 
submitted via the portal account),
