Management of conflicts of interests in public sector/
Dear European Union Agency for Fundamental Rights,
Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain information about Management of conflicts of interests in public sector:
Conflicts of interest can be actual, perceived or potential.
• An actual conflict of interest involves a direct conflict between a public official’s current duties and responsibilities and existing private interests.
• A perceived or apparent conflict of interest can exist where it could be perceived, or appears, that a public official’s private interests could improperly influence the performance of their duties – whether or not this is in fact the case.
• A potential conflict of interest arises where a public official has private interests that could conflict with their official duties in the future.
1) I request access to the controller`s Check-document of declarations for absence of conflict of interest by Morten Kjaerum for 2007-2012 and the type of the conflict of interest found (actual, perceived or potential).
2) I request additional information in relation to declaration for 2013 http://fra.europa.eu/sites/default/files... and previous role of Morten Kjaerum as Director of Danish Institute for Human Rights http://www.europarl.europa.eu/sides/getD... .
The auditors name in the Check-document could be deleted.
3) If applicable I also request access to the Declarations by Morten Kjaerum submitted in his previous role as Director of Danish Institute for this contract http://www.asktheeu.org/en/request/731/r... or for any other contract concluded between FRA and Danish Institute for Human Rights disclosed here http://www.asktheeu.org/en/request/742/r...

Dear EU Agency for Fundamental Rights (FRA),
As requested I filled the form available in FRA website. I did it twice as first time I received failure error.
Taking view that in FRA internet site there is no Privacy Statement for this particular scope (access to documents), and no identity of data processor, as for instance is provided at courts http://curia.europa.eu/jcms/upload/docs/... , on mandatory cells I filed the address of this organization under whose site we started this public exercise titled “Access to Documents”.
Any of Privacy Statements available in fra internet http://fra.europa.eu/en/data-protection-... is applicable to requests to access documents. Therefore I do not know how FRA intends to use my private data and I have some reluctance to give it, taking view to the alleged infringements of law by FRA presented in this website.
Also I noted that FRA did not disclose the identity of FRA processor of personal data in any of the Privacy Statements published in internet http://fra.europa.eu/en/data-protection-.... If I am not wrong, the specific rules require such explicit disclosure of identity of the processor.
FRA nevertheless can send the documents requested directly on email provided and afterwards those documents will be uploaded under these 3 public requests to access documents.

The rule of this website is to upload documents received by email (example - http://www.asktheeu.org/en/request/olaf_...
I am confident that you will understand that this is the rule of this public exercise and we cannot change it substantially during the exercise. I observed that only in respect of my requests FRA asked changing the rules, asking for my cooperation (that my requests are filled through FRA site). I did it but I would prefer that FRA itself upload directly in this website – AskthEU the requested documents to be sent through email. This will be a proof that FRA has nothing to hide and refute the public allegations against it. Please be assured about our good intentions and that we just want to have the facts from all sides.
To this aim and a round overview of facts, could FRA confirm that the official mentioned in Parliamentary question E-007475-13 / 25/06/13 serves/served at FRA.

I am writing to request an internal review of European Union Agency for Fundamental Rights's handling of my FOI request 'Management of conflicts of interests in public sector/'.
I request revision of your decision not to grant me access to documents.
I submit also this link http://www.asktheeu.org/en/request/477/r... which shows that Mr Kjaerum was bound to lodge declaration for conflict of interest; the document must exist with a high degree of certainty. I request that all points in initial application are treated at this stage of confirmatory application.
