Dear Madam, Sir,

I refer to my access to documents request registered on 16 December 2024 under the case number 2024/6989. The request was supposed to have been handled within 15 working days, i.e. by 17 January 2025.

However , I have not received reply since that date, nor the required notification that the Commission needs an additional 15 working days - which by the way is only for exceptional cases.

Therefore I would like to urge the Commission to reply without any delay.

We are writing concerning your request for access to Commission documents
registered on 16/12/2024 under case number 2024/6989.

We are currently working on your request. However, we have not yet been
able to gather all the elements necessary to carry out a full analysis of
your request. We will not be able to send you the reply within the
prescribed time limit expiring on 17/01/2025. This is due to the fact that
the application concerns documents held by different Services, which are
subject to consultation.

Therefore, in line with Article 7(3) of [1]Regulation (EC) No 1049/2001,
we need to extend this time limit by 15 additional working days. The new
time limit expires on 07/02/2025.

I am filing the following confirmatory application with regards to my access to documents request registered on 16 December 2024 under the case number 2024/6989. The request has not been handled within the extended deadilne, which expired on 7 February 2025 - more than a month ago.

Article 7.4 of Regulation 1049/2001 states: "Failure by the institution to reply within the prescribed time-limit shall entitle the applicant to make a confirmatory application."

We refer to your complaint to the European Ombudsman concerning the
Commission‘s failure to reply to your request for clarification on the
reasons for extending the deadline to reply to your request for public
access to documents in case 2024/6989, submitted on 16 December 2024.

Following receipt of your confirmatory application, the
Secretariat-General consulted the relevant service to understand the state
of play in the preparation of the initial reply to your request. In
accordance with Article 8(2) of Regulation (EC) No 1049/2001, the
time-limit for responding to your request was extended to allow for the
completion of these internal consultations. 

The reasons for such extension were the fact that it was a broad request
requiring an extensive search, consultations with a new Cabinet and the
implementation of new rules of procedure.

We apologise that we were not in a position to provide a more detailed
explanation for the extension of the deadline to reply to your request at
the time. We hope that you find these clarifications useful and we thank
you for your patience.
