Date: Tue, 25 Oct 2022 17:25:39 +0000 Subject: Internal review of access to documents request - Meeting between Ylva Johansson and Charlotte Caubel From: Laura Kayali <[FOI #11893 email]> To: "[email address]" <[email address]> Dear Ms. Pariat, Thank you for getting back to me on such a timely matter and for providing documents. I fully agree with your analysis that the personal data of the people involved in the meetings should not be disclosed and I do not wish to know their names. However, I respectfully disagree with your assessment regarding the protection of the ongoing decision-making process and would please ask the European Commission to disclose the briefing (document 2) without the redacted parts. The position of member states on legislation that will affect 450 million people is of utter public interest, especially when said legislation has proven controversial and is meeting opposition from digital rights NGOs and MEPs (see here https://www.politico.eu/article/eu-commission-violation-privacy-endangering-encryption/- Furthermore, the position of another member state, ie Germany, is very much public (see here https://www.politico.eu/article/germany-eu-damage-control-encryption-abuse-online/) which has not jeopardized the ongoing decision-making process — on the contrary, it's part of democracy. The court of justice of the EU itself does not seem to think that what are designed to be closed-door meetings should remain under closed doors (see here https://www.euractiv.fr/section/justice-affaires-interieures/news/publish-secret-law-files-demands-eu-court-in-transparency-ruling/). The context is different but the philosophy behind the decision is the same. Thank you. Yours sincerely, Laura Kayali -----Original Message----- Hello, Please find attached a message concerning your request for access to Commission documents registered under the above case number 2022/5604.
