We are writing concerning your request for access to Commission documents
for case 2025/6410 registered on 02/02/2026.

We apologise for the delay. However your application concerns a very large
number of documents, which need to be assessed individually.

Furthermore, the handling of your request involves the assessment of many
documents originating from third parties. The analysis of these documents,
together with the need to consult the third parties concerned in
accordance with Article 4(4) of Regulation (EC) No 1049/2001, cannot be
expected to be completed within the normal time limits set out in Article
7 of Regulation (EC) No 1049/2001.

However, Article 6(3) of Regulation (EC) No 1049/2001 also provides for a
possibility to confer with an applicant informally with a view to finding
a fair solution when an application relates to a very long document or
concerns a very large number of documents.

Based on the above-mentioned provision, we would kindly ask you to narrow
down the number of documents that you are interested in to a total number
of maximum 20 documents. In order to help you to narrow down your

Dear Mr GUÉRIN,

We are writing in relation your correspondence regarding the
identification of documents in our reply letter for your case EASE
2025/6410.

We clarify that access to the position paper referenced under point 5
(Ares(2025)561418) must be refused, as its release would hamper the
commercial interests of the legal person concerned.

Under Article 4(2) of Regulation (EC) No 1049/2001, the document contains
commercially sensitive business information, including intellectual
property and its disclosure would compromise the protection of the
commercial interests of the legal person involved. Please note that the
third party was consulted in accordance with the provisions of Regulation
1049/2001 and refused the disclosure of its position paper. We considered
the possibility of partial access, however the exception under Article
4(2) applies to the document in its entirety, and any redacted version
would render the disclosure meaningless.

We apologise again for the misunderstanding and any inconvenience this may
have caused.
