Dear Mr Wachowiec,
I refer to your application for access to documents under Regulation (EC) No 1049/2001
regarding public access to European Parliament, Council and Commission documents

Your request concerns “
the minutes and soundtrack of the hearing under the Rules of Procedure
of the Court in the Cases C-156/21, Hungary v Parliament and Council2, and C-157/21, Poland
v Parliament and Council”
.3 Please note that, since minutes and soundtracks of hearings taking place at the Court of Justice
are not notified to the Commission as part of the court proceedings, the Legal Service does not
hold any document matching the terms of your request.
Article 2(3) of Regulation No 1049/2001 states that “[
T]his Regulation shall apply to all
documents held by an institution, that is to say, documents drawn up or received by it and its
possession, in all areas of activity of the European Union”. Consequently, the Commission is not
in a position to fulfil your request.
Should you contest this position, you should present in writing, within fifteen working days from
receipt of this letter, a confirmatory application to the Commission's Secretariat-General to the
