National plans implementing the "Pact on Migration and Asylum" (see COM (2024) 251
Dear Secretariat General of the European Commission,
Under the right of access to documents as foreseen by art.15.3 TFEU, currently framed by Regulation 1049/2001 and as interpreted by the CJEU Jurisprudence I am requesting, together with the representatives of the Civil Society, of the Academia and of the EU Media listed below, the National Implementation Plans foreseen by the EU Common Implementation Plan ( COM(2024) 251) of the EU Pact on Asylum and Migration.
These National Plans were due to be submitted to the European Commission by December 12th,2024. As provided for in the Asylum and Migration Management Regulation and the Asylum Procedure Regulation, these National Implementation Plans are an essential preliminary step in view of the relevant EU financial transferts and the establishment of comprehensive national migration and asylum strategies ( to be transmitted by the Member States to the Commission by June 2025).
Needless to say all these documents are deemed to have an essential impact on the protection and promotion of Fundamental rights and on the sound use of EU financial resources at national and supranational level.
Please notice that we are requesting these National Implementing Plans in view of submitting in a timely manner, possible suggestions and observations not only at national level (as already recommended by the EU Common Implementation Plan *) but notably at European level before the finalization of the relevant procedures. A swift trensmission or publication of the relevant national plans will, then, be more appreciated.

Why do we need your personal postal address?
Since 1 April 2014, the submission of a postal address became a mandatory
feature when submitting an application for access to Commission documents
via an e-mail. We would like to explain why we need your postal address in
order to register and handle your application for access to documents when
submitted via e-mail:
• Firstly, to obtain legal certainty as regards the date you received
the European Commission reply to your application for public access to
documents. Article 297 of the Treaty on the Functioning of the
European Union (TFEU) states that 'decisions which specify to whom
they are addressed, shall be notified to those to whom they are
addressed and shall take effect upon such notification.' In line with
this provision, if the Commission does not grant full access to the
requested documents, it notifies the reply to the applicant via
registered mail with acknowledgement of receipt or via delivery
service. This requires an indication of a valid postal address by the
applicant;
• Secondly, to apply correctly the [2]Data Protection Regulation (EU)
2018/1725. Knowing whether the applicant is an EU resident (or not) is
necessary for deciding which conditions shall apply for the
transmissions of personal data to applicants for access to documents.
These conditions are not the same for recipients established in the
Union and for recipients in third countries. As the vast majority of
the documents requested contain personal data, the Commission cannot
ensure the correct application of the data protection rules in the
absence of a postal address;
• Thirdly, to apply correctly [3]Regulation (EC) No 1049/2001. Article
4(1)(b) of that Regulation refers to the protection of the privacy and
integrity of the individual and has to be applied in line with the
Data Protection Regulation;
• Fourthly, to protect the interest of other citizens and safeguard the
principle of good administration. The Commission has to treat all
citizens equally by ensuring that the legal framework for public
access to documents is respected. For example, it has to verify
whether Article 6(3) of Regulation (EC) No 1049/2001 is being evaded
by introducing several requests under different identities. Indeed, in
its Ryanair judgment ([4]EU:T:2010:511), the General Court confirmed
that Article 6(3) of Regulation (EC) No 1049/2001 cannot be evaded by
splitting an application into several, seemingly separate, parts. In
addition, the Commission has to make sure that the legal framework is
respected and the right of access to documents is not abused by making
requests under an invented identity.
The considerations above show that the request for and the consequent
processing of the applicant's postal address is not only appropriate, but
also strictly necessary for the performance of a task carried out in the
public interest within the meaning of Article 5(1)(a) of Data Protection
Regulation, namely providing a smooth and effective access to documents.

This is a CONFIRMATORY APPLICATION of January 17th , request of access to National Implementation Plans foreseen by the EU Common Implementation Plan ( COM(2024) 251) of the EU Pact on Asylum and Migration. (see (1) below).The deadline for the reply to the request of access, was February 28th (see Commission Service communication below –(2)).
Unfortunately no public information has been disclosed on this subject until today and we have been informed that notwithstanding the Commission commitment to submit semestrial periodic reports to the Council and to the European Parliament (paragraph 5.1 of the Commission Common Implementation Plan) the EP has not received so far any written information from the Commission.
The European Commission refusal to answer and follow up on the request for access to documents or to respond to it conflicts with the EU Institutions obligation to answer (in a reasonable time) to an European Citizen demand (see Article 20(2)(d) of the TFUE and art.41.4 of the Charter of Fundamental Rights).
Therefore, together with the other Civil Society Representatives supporting my initial request We submit this CONFIRMATORY APPLICATION because we consider that disclosing the content of the national implementing plans is essential for understanding how the EU Pact on Asylum and Migration will be implemented, in a shared responsibility, by the European Institutions and by its Member States.
As this decision making process is framed in detail by EU law We consider that it shall comply with the EU principle of openness (art 1 TEU) and Article 15(1) TFEU. This principle provides that the institutions, bodies, offices and agencies of the European Union are to conduct their work as openly as possible. The same principle of openness is expressed in Article 10(3) TEU, in Article 298(1) TFEU, and in Article 42 of the Charter of Fundamental Rights of the European Union which enshrines the right of access to documents (see judgments: C-726/22 “Pollinis v France”, 16/01/2025, paragraph 59, and “Council v Pech”, of 8 June 2023, C 408/21 P, EU:C:2023:461, paragraph 30 and the case-law cited).
It is worth noting that, when preparing the National Implementing Plans, such principle of openness was not implemented in most of the Member States notwithstanding the Commission recommendation "..to engage and make use of social partners, local and regional authorities and other stakeholders, in particular representatives of civil society organisations, through regular exchanges and consultation. This helps to identify challenges, improve policy solutions and ensure broader ownership during the preparation of the National Implementation Plans and subsequently during its implementation, where these same actors often play critical roles.”
However if also at EU level,no information is disclosed and any meaningful dialogue with the EU Citizens and civil society take place (as required by art 11 TEU) all the process bringing to the implementation of the Pact of Migration and asylum will take place in violation of art. 15.1 TFEU according to which “In order to promote good governance and ensure the participation of civil society, the Union institutions, bodies, offices and agencies shall conduct their work as openly as possible.”)
It is worth recalling that the EU Common implementation Plan has foreseen several milestones (3) which have to be followed in sequence, as each one of them is the premise of the following one. In this perspective the National implementation plans already submitted on December 12th,2024 are of decisive importance as they:
- have been established according to an EU Template with the support of the Commission and relevant Union bodies, offices and agencies,
- mapped the current national situation, the context, the current legislative framework and administrative practices, the organisational set-up and structures in place, the existing capacities as well as the challenges linked to geographic circumstances;
-will be taken in account by the first annual solidarity cycle (starting in June 2025) which will be followed in October 2015 by a Commission Decisions determining the Member States under migratory pressure, at risk thereof, or those facing a significant migratory situation)
As we are already entered in the second phase of this EU decision making process (NB : according to the CJEU ‘decision-making process’, must be construed as relating to decision-making, without covering the entire administrative procedure which led to the decision (judgment of 13 July 2017, Saint-Gobain Glass Deutschland v Commission, C 60/15, EU:C:2017:540, paragraph 76) excluding these National Plans from public scrutiny because of the "protection of the decision making process" will be no more acceptable (see also C-726/22 “Pollinis v France”, 16/01/2025, par 74, 2nd phrase)
Therefore, I formally request the Commission to reply to this CONFIRMATORY APPLICATION not later than 15 working days from its registration.

(3) Key indicative milestones for Member States to consider in their planning:
By 1 July 2024, Member States should set up national coordination structures and appoint the national coordinator (if not done already).
By October 2024, Member States should submit their draft National Implementation Plan to the Commission.
By 12 December 2024, Member States shall communicate their National Implementation Plan to the Commission.
By first half of 2025, the Commission will adopt the decision allocating funds under the national programmes in the context of the mid-term review of AMIF and BMVI, based on updated statistics reflecting the allocation key in 2021-2023.
By first half of 2025, the Commission will allocate part of the funding from the MFF mid-term review through the Thematic Facility to Member States.
By first half of 2025, Member State should launch procurement for acquiring of equipment and building activities.
By first half of 2025, Member States should launch the recruitment process.
By mid-2026, Member States shall be ready to apply the Pact on Migration and Asylum

Dear applicant,
