Dear Mr Fanta,

Thank you for your e-mail of 11 November 2020. We hereby acknowledge
receipt of your application for access to documents, which was registered,
after receiving confirmation of your postal address, on 12 November 2020
under reference number GESTDEM 2020/6880.

In accordance with Regulation (EC) No 1049/2001 regarding public access to
European Parliament, Council and Commission documents, your application
will be handled within 15 working days. The time limit will expire on 2
December 2020. In case this time limit needs to be extended, you will be
informed in due course.

You have lodged your application via a private third-party website, which
has no link with any institution of the European Union. Therefore, the
European Commission cannot be held accountable for any technical issues or
problems linked to the use of this system.

Please note that the private third party running the AsktheEU.org website
is responsible and accountable for the processing of your personal data
via that website, and not the Commission. For further information on your

We understand that the third party running the AsktheEU.org website

correspondence.  In that case, the Commission will send all future
electronic correspondence addressed to you only to that private address,
and it will use only that private address to reply to your request. You
should still remain responsible to inform the private third-party website
about this change of how you wish to communicate with, and receive a reply
from, the Commission.

Dear Mr Fanta,

We refer to your request dated 11 November 2020 in which you make a
request for access to documents, registered on 12 November under the above
mentioned reference number.

Your application is currently being handled. However, we will not be in a
position to complete the handling of your application within the time
limit of 15 working days, which expires on 3 December 2020.

An extended time limit is needed as (part of) the documents requested
originate from third parties which have been consulted.

Therefore, we have to extend the time limit with 15 working days in
accordance with Article 7(3) of Regulation (EC) No 1049/2001 regarding
public access to documents. The new time limit expires on 4 January 2020.

We apologise for this delay and for any inconvenience this may cause.

Yours faithfully,

Dear Mr Fanta,

Further to our previous exchange, please note that there was a typo in the
previous email which extended the time limit for completing the handling
of your application.

The new time limit expires on 4 January 2021 and not on 4 January 2020.

We apologise for the inconvenience.

Yours faithfully,

Dear Mr Fanta,

The European Commission has received an application for access to
documents under Regulation (EC) No 1049/2001 of the European Parliament
and of the Council of 30 May 2001 regarding public access to European
Parliament, Council and Commission documents. Please find herewith a copy
of the Regulation.

The applicant requests access to the attached document sent to the
Commission by you (Ares(2020)6608426).

The general principle of Regulation (EC) No 1049/2001 is to grant the
widest possible access to any document held by an EU-institution which is
requested under this Regulation. The institution only refuses disclosure
of (a part of) the requested document(s), if disclosure would undermine
the protection of a specific interest as laid down in Article 4 of this
Regulation.

As regards third-party documents, Article 4, paragraph 4 of Regulation
(EC) No 1049/2001 provides that ‘the institution shall consult the third
party with a view to assessing whether an exception in paragraph 1 or 2 is
applicable, unless it is clear that the document shall or shall not be
disclosed’.

With a view to handling this application, we invite you to indicate
whether you agree with disclosure of the document originating from you or,
on the contrary, object to disclosure. In case you wish to object to
disclosure, we kindly ask you to indicate how in your view, disclosure
would affect one of the interests protected under Article 4, paragraphs 1
or 2 of Regulation (EC) No 1049/2001.

Please note in this respect that your personal data, and contact will be
redacted by default, with reference to Article 4(1)(b) (protection of
privacy and the integrity of the individual) of Regulation (EC) No
1049/2001.

In case you consider that the document could be partially released, we
would kindly ask you to indicate/mark the (parts of the) document that
should be withheld and to give reasons for redacting them. The documents
is attached for your convenience.

In order to enable us to reply to the request for access within the
prescribed time limit, we would be grateful if you could inform us as soon
as possible and in any case within five working days upon receipt of this
letter, your position as regards the disclosure of the document concerned.

In case we do not receive a reply within the prescribed time-limit, we
will take a position on disclosure of the document requested taking
account of your legitimate interests on the basis of the information in
our possession.

In view of the short period allowed for the Commission's reply under
Regulation (EC) No 1049/2001, we would be grateful if you could reply by
e-mail to:

[1][email address]

Thank you in advance for your assistance.

Yours faithfully,
