Netherlands and Nitrates Directive
Dear Environment,
Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:
All documents between 01 June 2024 and 24 December 2025 – including but not limited to (draft versions of) minutes, (hand-written) notes, audio recordings, verbatim reports, operational conclusions, briefings, e-mails, attachments, letters, text messages, phone call notes, (powerpoint) presentations – related to the Netherlands and the Nitrates Directive, including but not limited to a Dutch derogation under this Directive.
Since the information might at least partly also concern "activities affecting or likely to affect" the "state of the elements of the environment", I believe Regulation 1367/2006 applies.
Should you encounter any difficulties in interpreting or processing my request, I am ready to discuss ways to clarify or amend it to keep the effort required on your part to the necessary minimum.
Please send me an acknowledgement of receipt for this request, as foreseen by Article 7 (1) of Regulation 1049/2001. I would appreciate it if you could send a list of documents that correspond to my request. Please note I prefer to receive the documents in digital format, not by physical mail. I also kindly request you make and digital files searchable using OCR.

Concerning my request for access to Commission documents registered on 5 January 2026 under case number EASE 2026/0027.
Please pass this on to the person who reviews confirmatory applications.
I am filing the following confirmatory application with regard to my access to documents request “Netherlands and Nitrates Directive”.
The initial deadline under Article 7(1) of Regulation 1049/2001 expired on 26 January 2026. The Commission subsequently extended the time limit pursuant to Article 7(3), setting a new deadline of 16 February 2026.
As of today, 27 February 2026, that extended deadline expired 11 days ago. I have not received a substantive reply to my request.
I therefore ask the Commission to review the handling of my request and to adopt a formal decision without further delay.
I would appreciate confirmation of receipt of this confirmatory application and look forward to receiving the Commission’s decision within the time limits laid down in Article 8 of Regulation 1049/2001.

Concerning my request for access to Commission documents registered on 5 January 2026 under case number EASE 2026/0027.
As you mention, the extended deadline of 15 April 2026 has now expired. Article 8(1) of Regulation (EC) No 1049/2001 requires a confirmatory reply within 15 working days, and Article 8(2) allows only one extension of 15 working days in exceptional cases. The Regulation does not permit an open-ended delay. Please therefore, within five working days, provide a new concrete deadline for the confirmatory reply and confirm the stage at which the application currently stands.
