Position of Care France on the scandal of the interdiction of adoptions from Romania

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:
A document that contains de position of the NGO Care France related the the - in their own words - "Le Scandale de l'Interdiction de l'adoptions internationale des enfants roumains abandonnes".
We asked for such document already in 2013.
We did not get it.
The European Ombudsman did not consider our complaint about it as admissible.
However, in the meantime we have obtained the document through other sources, although not with all annexes.
Therefore, we hereby request you to make this document public.
On 29 December 2005 it was first registered by the Cabinet of Commissioner Spidla, and attributed to the Secretariat General.
The SecGen registered it on 12 January 2006, SG-2 - nr A 392.
Please provide public access to this document including its annexes and the Adonis registration sheet, and any documents related to its follow-up.
Considering the ongoing scandals and investigations into the issue of the Romanian Children File, which includes the looking into of the creation and tasking of Against Child Trafficking by the European Commission to continue the work in the spirit of the Romanian Children File - while seconding its Task Manager Roelie Post to the organisation in the Commission's best interest, we consider it in the wider public interest to make this document public.
The file, which dates back over almost two decades, holds valuable information that could tie the ongoing investigations together. It is essential to demonstrate how the earlier actions and documents, including internal briefings and responses, are part of a larger conspiracy.

I am writing to submit a confirmatory application pursuant to Regulation (EC) No 1049/2001 regarding the European Commission’s response to the "Ask-the-EU" Freedom of Information request.
The Commission’s handling of this request is inadequate and unacceptable, particularly given the public interest in the case of whistleblower Roelie Post and the apparent efforts to obscure information related to the Romanian Children File.
In 2013, we requested public access to the document in question and received only the first two pages, unredacted. In the recent response, however, the Commission has excessively redacted most of the text and all names, rendering the document effectively meaningless. Furthermore, the annexes, which we explicitly requested, were not disclosed. This level of redaction and omission is unjustified and undermines the principles of transparency and accountability enshrined in EU law.
Additionally, the Commission provided a registration document only for Commissioner Spidla. No registration sheets were provided for Commissioners Frattini, Rehn, and Barrot, nor was any explanation given as to whether these Commissioners registered the document. We request that the Commission clarify this matter and provide the relevant registration sheets or confirm their absence with a reasoned justification.
The handling of this request is particularly concerning in light of the case of Roelie Post, a whistleblower who was dismissed, purportedly for reasons unrelated to her work on the Romanian Children File. Publicly available media, documents, and other evidence strongly suggest otherwise. The Commission’s excessive redactions and failure to disclose requested documents, including the annexes, appear to constitute a deliberate cover-up, further eroding public trust in the institution. This lack of transparency is not only inconsistent with Regulation (EC) No 1049/2001 but also reinforces the perception that the Commission is concealing information to protect institutional interests over public accountability.
We therefore urge the Commission to:
- Provide the requested document in full, with minimal and strictly justified redactions, as required by Regulation (EC) No 1049/2001.
- Disclose the annexes, as explicitly requested, with clear reasoning for any redactions.
- Provide the registration sheets for Commissioners Frattini, Rehn, and Barrot, or a detailed explanation for their absence.
- Reassess the application of exceptions under Regulation (EC) No 1049/2001, ensuring that any refusal to disclose is narrowly construed and justified in light of the overriding public interest in transparency regarding Roelie Post’s case and the Romanian Children File.
The Commission’s current approach is unacceptable and contrary to the EU’s commitment to openness and accountability. We expect a prompt and comprehensive response to this confirmatory application, addressing all points raised.
