Dear Mr LENA,
We refer to your e-mail dated 23/03/2023 in which you make a request for access to
documents, registered on 30/03/2023 under the above-mentioned reference number. We
also refer to the reply extension limit communicated on 24/04/2023 with internal
reference number Ares(2023)2881363.
You request access to the following documents:
-
documents which contain the following information, in relation to the RangER
program mentioned above and funded by the EU, starting in 2020:
“All the documents related to soil surveying and to the ecological and
environmental impact assessment of grass/pasture production, including the
methodology for the surveys and assessments, as well as their results, for all the
conservancies concerned. These activities are mentioned in the Annex III of the
RangER program Grant Contract, in the Budget for the Action, Result Area 2 on
“Land use planning”.
We regret to inform you that the Commission does not hold any documents that would
correspond to the description given in your application.
Following extensive check, the Commission only received narrative reports summarising
the surveys and impact assessments in relation to the RangER program, but not the original
documents themselves. You already received the year 1 narrative report, as it is included in
the GESTDEM access to documents request with reference number 2022/4536.
As specified in Article 2(3) of Regulation (EC) No 1049/2001, the right of access as
defined in that regulation applies only to existing documents in the possession of the
institution.

Given that no such documents, corresponding to the description given in your
application, are held by the Commission, the Commission is not in a position to fulfil
your request.
In accordance with Article 7(2) of Regulation (EC) No 1049/2001, you are entitled to make
a confirmatory application requesting the Commission to review this position.
Such a confirmatory application should be addressed within 15 working days upon receipt
