Refined request for access to documents – renewable energy cooperation with Algeria (EASE 2026/1028 follow-up)
Dear Secretariat General,
I am writing in follow-up to my confirmatory application (EASE 2026/1028) concerning documents related to Commissioner Jørgensen’s meetings with Algerian officials in February 2026.
In light of the partial access granted, I would like to submit a refined request for access to documents, specifically targeting renewable energy cooperation and energy transition elements, with a narrower scope designed to address the concerns set out in your decision.
I request access to non-redacted or further partially disclosed sections of Documents 1, 2 and 3 that relate exclusively to:
- Renewable energy cooperation between the EU and Algeria
- Electricity interconnection projects (including but not limited to Medlink)
- Hydrogen development and infrastructure (including the South H2 Corridor)
- Energy efficiency and methane emissions mitigation linked to the energy transition
For the avoidance of doubt, this request does not seek access to:
- political or diplomatic positioning
- references to international disputes or geopolitical issues
- internal “lines to take”, “defensives”, or sensitive negotiation strategies
This request is therefore limited to technical, policy, and implementation-related aspects of renewable energy cooperation.
I would like to set out a specific and substantiated overriding public interest in disclosure, tailored to the content requested:
- The documents refer to EU initiatives on renewable energy transition, hydrogen infrastructure, and electricity interconnection, which are central to EU climate policy and energy security.
- These initiatives relate directly to the EU’s legally binding climate targets, including decarbonisation and methane reduction objectives.
- Public understanding of how such projects are developed with third countries is essential for:
i) assessing the alignment of EU external energy policy with climate goals
ii) ensuring transparency in infrastructure investments and partnerships
iii) enabling informed democratic scrutiny of the EU’s external dimension of the Green Deal
This request is therefore not based on a general transparency interest, but on the specific need to scrutinise the EU’s external renewable energy strategy and its implementation.
This refined request directly addresses concerns of the Commission's initial decision by:
- Excluding geopolitical and sensitive diplomatic content, including negotiation strategies and bilateral political assessments
- Focusing only on technical and policy elements of renewable cooperation, which are already subject to public policy debate
- Requesting segregable information, in line with Article 4(6) of Regulation 1049/2001
Given this narrowed scope, disclosure would not reasonably undermine the protected interests identified, as it avoids the categories of content the Commission considers most sensitive.
I note that some redactions relate to ongoing internal deliberations and future policy actions. Where relevant, I request access to:
- information relating to initiatives that have since progressed or been formalised, and
- factual or descriptive content that does not reveal internal deliberative positions
This approach aligns with case-law requiring that access be reconsidered where the risk to decision-making has diminished over time.
In line with Article 4(6) of Regulation 1049/2001, I am requesting:
- further partial access, where full disclosure is not possible
- extraction of technical summaries or factual passages relating to renewable energy cooperation

Why do we need your personal postal address?
Since 1 April 2014, the submission of a postal address became a mandatory
feature when submitting an application for access to Commission documents
via an e-mail. We would like to explain why we need your postal address in
order to register and handle your application for access to documents when
submitted via e-mail:
• Firstly, to obtain legal certainty as regards the date you received
the European Commission reply to your application for public access to
documents. Article 297 of the Treaty on the Functioning of the
European Union (TFEU) states that 'decisions which specify to whom
they are addressed, shall be notified to those to whom they are
addressed and shall take effect upon such notification.' In line with
this provision, if the Commission does not grant full access to the
requested documents, it notifies the reply to the applicant via
registered mail with acknowledgement of receipt or via delivery
service. This requires an indication of a valid postal address by the
applicant;
• Secondly, to apply correctly the [2]Data Protection Regulation (EU)
2018/1725. Knowing whether the applicant is an EU resident (or not) is
necessary for deciding which conditions shall apply for the
transmissions of personal data to applicants for access to documents.
These conditions are not the same for recipients established in the
Union and for recipients in third countries. As the vast majority of
the documents requested contain personal data, the Commission cannot
ensure the correct application of the data protection rules in the
absence of a postal address;
• Thirdly, to apply correctly [3]Regulation (EC) No 1049/2001. Article
4(1)(b) of that Regulation refers to the protection of the privacy and
integrity of the individual and has to be applied in line with the
Data Protection Regulation;
• Fourthly, to protect the interest of other citizens and safeguard the
principle of good administration. The Commission has to treat all
citizens equally by ensuring that the legal framework for public
access to documents is respected. For example, it has to verify
whether Article 6(3) of Regulation (EC) No 1049/2001 is being evaded
by introducing several requests under different identities. Indeed, in
its Ryanair judgment ([4]EU:T:2010:511), the General Court confirmed
that Article 6(3) of Regulation (EC) No 1049/2001 cannot be evaded by
splitting an application into several, seemingly separate, parts. In
addition, the Commission has to make sure that the legal framework is
respected and the right of access to documents is not abused by making
requests under an invented identity.
The considerations above show that the request for and the consequent
processing of the applicant's postal address is not only appropriate, but
also strictly necessary for the performance of a task carried out in the
public interest within the meaning of Article 5(1)(a) of Data Protection
Regulation, namely providing a smooth and effective access to documents.
