We would like to refer to  you e-mail of 16/5/2017 in which you made a
request for access to the documents which contain information on the
rental contract of the building the agency occupies, and which was
registered under the reference number INEA 2017/11.

Your application is currently being handled, however, an extended time
limit is needed as your application concerns documents held by different
entities which are being consulted.

Therefore, we have to extend the initial time limit with 15 supplementary
working days, in accordance with Article 7(3) of Regulation (EC) No
1049/2001 regarding public access to documents. The new time limit expires
on 29/6/2017.

Dear Mr. Teffer,

We would like to refer to you e-mail of 16/5/2017 in which you made a
request for access to the documents which contain information on the
rental contract of the building the agency occupies, and which was
registered under the reference number INEA 2017/11.

Having examined the document requested under the provisions of Regulation
(EC) No 1049/2001 regarding public access to documents, I have come to the
conclusion that the 'Convention'and its 'Avenant' may be partially
disclosed. Some parts of the documents have been blanked out as their
disclosure is prevented by exceptions to the right of access laid down in
Article 4 of this Regulation.

Article 4 (1) foresees that "the institutions shall refuse access to a
document where disclosure would undermine the protection of:

- (a) the public interest as regards: - public security (...); and

- (b) privacy and the integrity of the individual, in particular in
accordance with Community legislation regarding the protection of personal
data. "

With regard to point (a), the INEA considers that certain parts of the
document in question contain sensitive information whose disclosure could
entail a risk to the public security and particularly to the Agency's
staff, such as plans of the building as well as security and surveillance
information of the building, and therefore, access should be refused. This
information is namely in annexes I, II and III of the "Convention” and its
'Avenant'. These annexes are entirely covered by the exceptions described
above since they contain only security related information. Therefore
partial disclosure of these annexes is not meaningful as they would be
totally blacked out.

With regard to point (b), certainly the identified document contains some
personal data, such as the name, surname, personal address, signature, and
signed initials of certain members of the staff of the Agency and/or the
company owning the building that signed the contract. There is also other
personal data, such as the names of the contractors or of the notaries
involved in the contract. This information appears both in the main part
of the documents "Convention" and its 'Avenant'  and in particular in the
annexes.

You will receive a second e-mail with the rest of annexes to be disclosed.

In accordance with Article 7(2) of Regulation 1049/2001, you are entitled
to make a confirmatory application requesting INEA to review this
position.

Such a confirmatory application should be addressed within 15 working days
upon receipt of this letter to the Director of INEA at the following
