Request for documents on trade arguments and international negotiations related to harm reduction products

We're waiting for Irene van den Berg to read a recent response and update the status.

Dear Trade,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

I request access to all documents (including correspondence, meeting notes, internal assessments, and draft position papers) from 1 January 2021 to the present, concerning:
– Contacts with tobacco companies or their representatives regarding the trade or export of e-cigarettes, heated tobacco, or nicotine pouches.
– Use of trade or competitiveness arguments to influence EU positions on harm reduction products in the context of international negotiations or WTO discussions.
– Communications with Member States linking tobacco harm reduction products to economic or trade policy.

I would like the search to cover the period from 1 January 2021 to the present.

If parts of the requested documents are covered by exceptions under Regulation 1049/2001, I kindly ask for partial access to be granted to the remaining parts. I am also open to receiving the documents in electronic format.

Thank you very much for your message and for the detailed explanation regarding the scope and workload associated with my request.

My sincere apologies for not replying within the five-day period mentioned in your letter. I still wish to pursue the request and would like to cooperate in finding a fair solution under Article 6(3) of Regulation 1049/2001.

To facilitate processing, I am happy to narrow down the scope of my application as follows:

– Please limit the search to the period 1 January 2023 to the present.
– Please focus on correspondence (including emails), meeting minutes and briefings relating to contacts with tobacco companies (BAT, PMI, JTI, Imperial Brands) or their EU-level associations (Tobacco Europe, IEVA) concerning trade, export or market access issues for e-cigarettes, heated tobacco or nicotine pouches.
– I am particularly interested in documents where trade or competitiveness arguments were discussed in the context of WTO or international trade policy.

If the number of documents still exceeds a manageable level, I would appreciate it if you could select up to 25–30 representative documents covering these topics, as suggested in your letter.

I confirm that I am happy to receive the documents in electronic format and to accept partial access where necessary.
