Request for Roadmaps related to Strategic Partnership Agreements signed with Sub-Saharan African Countries

Tabeth Masengu made this access to documents request to International Partnerships Automatic anti-spam measures are in place for this older request. Please let us know if a further response is expected or if you are having trouble responding.

Response to this request is long overdue. By law, under all circumstances, International Partnerships should have responded by now (details). You can complain by requesting an internal review.

Dear International Partnerships,

I am the Director of Advocacy and Lobbying for an EU Civil Society Network registered in Brussels and registered in the Transparency Register.

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I hereby request access to the following documents:

1.) The Roadmaps linked to the Memoranda of Understanding between the EU and the governments of Namibia, Rwanda, the Democratic Republic of Congo, and Zambia on critical raw materials value chains (from 1 January 2020 onwards).

2.) Monitoring or evaluation documents linked to the Roadmaps, including progress reports, reviews, and updates.

I kindly request that the documents be provided on a rolling basis. The retrieval or review of certain documents should not delay the release of others already identified, which are eligible for disclosure. If the application involves a large number of documents, I am open to discussing a fair solution within the established limits.

To the extent possible, I would prefer to receive the documents in electronic format. Should access be refused in whole or in part, I request that the decision specify the reasons for refusal by reference to the relevant exceptions under Regulation 1049/2001.

In the case of partial refusal, it is expected that partial access in line with Article 4(6) of the Regulation will be granted.

Please do not hesitate to contact me if you require any clarification of this request.

Thank you in advance for your assistance.

Yours faithfully,

Dr. Tabeth Masengu (PhD)

INTPA-DOSSIERS-ACCES@ec.europa.eu,

Dear Mr. Masengu,

We have taken note of your request, however we need to consult and receive
the agreement of the partner country before we can disclose the Roadmaps
agreed under the respective Memorandum of Understanding establishing a
Strategic Partnership on raw materials value chains. This means that we
would need to consult the Governments of the Democratic Republic of Congo,
Zambia and Namibia and receive their agreement.

No Roadmap exists to date under the MoU with Rwanda.

We will handle it as a matter of priority, but you may understand that
this will possibly require some time.

kind regards,

Elisabetta Sartorel

Dear International Partnerships,
Dear Ms Sartorel,

I am following up on my access to documents request of 24 September regarding the Roadmaps linked to the Memoranda of Understanding between the EU and the governments of Namibia, the Democratic Republic of Congo, and Zambia on critical raw materials value chains. We note that no roadmap exists under the MoU with Rwanda.

In your previous reply, you indicated that consultations with the partner governments were required prior to disclosure. However, more than three weeks have now passed since my initial request, and the time limit established under Regulation (EC) No 1049/2001 for responding to access to documents requests has expired.

I therefore kindly but firmly request an update on the status of these consultations and a clear indication of when the requested documents will be provided.

Thank you in advance for your assistance.

Yours faithfully,

Dear International Partnerships,
Dear Ms Sartorel,

This is another eminder regarding my access to documents request “Request for Roadmaps related to Strategic Partnership Agreements signed with Sub Saharan African Countries”, submitted on 24 September.

The legal deadline under Regulation 1049/2001 has passed several weeks ago, and I have neither received the requested documents nor an explanation for the delay. As this request is now significantly overdue, I kindly ask for an immediate update and a clear indication of when I can expect a reply.

If no response is provided without further delay, I will request an internal review to understand why this case has not been handled within the required timeframe.

Thank you for your cooperation.

Yours faithfully,
