Dear European Border and Coast Guard Agency,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents regarding HAPS testing.

This request concerns documents related to Frontex's development and testing of high-altitude surveillance systems for border management purposes. Specifically, I seek access to all documents pertaining to the following projects and activities:

1. High-Altitude Surveillance Systems Development Programme
Documents related to the programme initiated following the 2023 feasibility study on the maturity of high-altitude systems, including but not limited to:
• The 2023 feasibility study on high-altitude systems maturity and any related assessments or evaluations
• Strategic documents and proposals submitted to the European Commission regarding the integration of high-altitude systems into the Integrated Border Management Fund and the Border Management and Visa Instrument
• Technical specifications describing systems operating at various altitudes, from high altitude (just below outer space) down to sea surface level
• Documentation concerning the planned mid-2025 call for fostering the inclusion of uncrewed capabilities in the European Border and Coast Guard as a whole
• Plans, strategies, and frameworks for integrating these systems into a network operating at all altitudes within Frontex operations

2. 2025 High-Altitude Systems Pilot Programme
All documentation related to the planned 2025 pilot programme for high-altitude systems, including:
• Operational plans and timelines for the 2025 pilot programme
• Budget and costs plans
• Technical specifications of the high-altitude systems to be tested
• Risk assessments and safety protocols
• Monitoring and evaluation frameworks for the pilot activities

3. Mediterranean Test Flight
Complete documentation concerning the test flight over the Mediterranean planned for summer 2025, including but not limited to:
• Detailed flight plans, including routes, altitudes, duration, and operational parameters
• Authorisations obtained from national aviation authorities and any relevant international bodies
• List of all authorities, agencies, and entities involved in or consulted regarding the test flight
• Reports on test outcomes, including technical performance data, operational findings, and any incidents or anomalies recorded
• Data protection impact assessments and fundamental rights compliance documentation

4. Contractual and Procurement Documentation
All procurement-related documents, including:
• Public procurement notices, calls for tenders, or requests for proposals related to high-altitude surveillance systems
• Contracts awarded to suppliers, manufacturers, or service providers for the development, testing, or deployment of such systems
• Financial documentation indicating budgets allocated to these programmes

5. Inter-Institutional and Stakeholder Correspondence
Communications and correspondence with:
• The European Commission, particularly regarding funding instruments and policy integration
• EU Member States and their relevant authorities concerning national cooperation, airspace authorisations, and operational coordination
• Third-country authorities, if applicable
• Private sector entities, research institutions, or technology providers involved in the development or supply of high-altitude systems
• International organisations or bodies, including aviation and space authorities

6. Legal and Compliance Documentation
Documents addressing legal, regulatory, and ethical considerations, including:
• Legal opinions or analyses concerning the deployment of high-altitude surveillance systems
• Fundamental rights impact assessments
• Data protection impact assessments conducted pursuant to Regulation (EU) 2016/679 (GDPR)
• Consultations with the European Data Protection Supervisor or other relevant oversight bodies

I request that the documents be provided in electronic format, preferably via email or through a secure download link. Should any of the requested documents be subject to exceptions under Article 4 of Regulation (EC) No 1049/2001, I kindly ask that you provide partial access to those documents where possible, redacting only the specific information that falls under the applicable exception.
