EIOPA may also consider more than one of the grounds for refusal set out in Article 4 of Regulation
(EC) No 1049/2001. Subject to Article 4(6) of that Regulation, if only parts of a requested document
are covered by any of the exceptions, EIOPA releases the remaining parts of that document.

REQUEST FOR ACCESS TO THE RESPONSES TO 'DISCUSSION PAPER ON THE PRUDENTIAL TREATMENT
OF SUSTAINABILITY RISKS'
With regard to this request, please be informed that the contributions and the names of the
contributors are internal documents that EIOPA received in relation to a matter on which EIOPA has
not taken yet its decision. EIOPA is stil processing these documents and the feedback contained
therein. In view of this, and in order not to undermine the above-referenced decision-making process,
EIOPA is not allowed to disclose the requested materials in accordance with the first sub-paragraph of
Article 4(3) of Regulation (EC) No 1049/2001.
In this context, EIOPA did not find any evidence, and you have not indicated any specific circumstances
demonstrating the existence of a public interest in the disclosure of the requested documents,
overriding the exemption under the first sub-paragraph of Article 4(3) of
Regulation (EC) No 1049/2001.
Furthermore, please note that as part of the consultation process, some contributors explicitly
requested confidential treatment of their contributions and as such EIOPA may not disclose them in
view of its professional secrecy obligations under Article 70 of Regulation No 1094/2010.
For all these reasons, EIOPA regrets to inform you that it cannot grant you access to the contributions
and the names of the contributors (i.e. your alternative request for a full list of the respondents).
Nevertheless, we would like to highlight that subject to the finalisation of its decision-making process,
EIOPA expects to publish al non-confidential contributions in the third quarter of 2023. Hope you will
find this information helpful.
MEANS OF REDRESS
In accordance with Article 7(2) of Regulation No 1049/2001, you are entitled to make a confirmatory
application requesting EIOPA's Executive Director to review this position on your access to documents
request.
Such a confirmatory application should be addressed within fifteen working days upon receipt of this
