I am filing the following confirmatory application with regards to my access to documents request 'Romania - Proposal for enhanced monitoring of children's rights'.

Legal time limit expired.
We get the impression that either there was no proper archiving, but that's rather unlikely. Or DG NEAR is intentionally delaying and finally 'not finding' documents.
This is a recurrent issue in a file - The Romanian Children File - that was filled with conflicts of interest, abuse of position, abuse of power.

A lot, but not all, is public knowledge since spring 2007, when the book Romania for Export Only, the untold story of the Romanian 'Orphans' was published by Roelie Post. At the incentive and appreciation of Secretary General Catherine Day and Vice President Gunter Verheugen.

The requested note was drafted by the two whistleblowers on the Romanian Children File.

Subject: Romania – Proposal for enhanced monitoring of children’s rights

The law on Children’s Rights and the Law on Adoptions has entered into force on 1 January 2005. In general, the Commission should monitor that future modification of the legislation on children’s rights and adoption and secondary legislation maintain the same the level of protection. The UNCRC and the ECHR, as well as the reports of the Independent Panel, should serve as guidelines for the monitoring. The Independent Panel’s opinion could also be asked on specific issues, if necessary.

The implementation of the new legislation on Children’s Rights and Adoption is part of Romania’s obligations under the UN Convention on the Rights of the Child.

I am filing the following confirmatory application with regards to my access to documents request 'Romania - Proposal for enhanced monitoring of children's rights'.

In the letter signed by Mª Victoria GIL CASADO, the Ares reference is given ELARG/A3/RP/KT D(2005) 214.
However, in the published note the initials KT and RP (Roelie Post) have been blackened.
At the same time, in other Ask the EU requests, the name of KT (later KdS) was not blackened.

Considering that the official you fired, Mrs. Roelie Post, is now considered a public person and acknowledged whistleblower (by the Dutch Parliament and the Dutch House for Whistleblowers who exceptionally dealt with her case at the request of Prime Minister Mark Rutte), we request her name to be exposed in all our request for access to documents related to her work.

In any case, the European Commission already often exposed her name before.
