Dear Secretariat General of the European Commission,
Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:
1. All correspondence exchanged between the European Commission and the organisers of the proposed European Citizens’ Initiative “Save Europe Act” concerning the assessment of its registration request, including any preliminary notification or warning sent to the organisers indicating that the Commission intended to refuse registration;
2. Any response(s) submitted by the organisers to that preliminary notification, including supporting arguments or amendments proposed prior to the final decision;
3. Any internal Commission notes, opinions, or assessments prepared in relation to the eligibility check of this initiative under Article 6 of Regulation (EU) 2019/788 on the European Citizens’ Initiative, insofar as these do not fall under a mandatory exception to disclosure;
4. The final decision letter communicated to the organisers refusing registration of the initiative.
We are seeking these documents in order to assess the reasoning and procedural fairness of the Commission’s eligibility check in this specific case, in the context of ongoing research and advocacy on the functioning of the European Citizens’ Initiative as a participatory democracy instrument.
In accordance with Article 7 of Regulation (EC) No 1049/2001, we would be grateful for a reply within 15 working days. Should any of the requested documents be withheld in whole or in part, we would appreciate a reasoned justification citing the specific exception(s) relied upon under Article 4 of the Regulation, together with an indication of any partial access that may be granted.
We would welcome electronic copies of the requested documents, in their original language(s).
