Dear European Court of Justice,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting the following information:

The European Court of Justice stance on Scotlands EU membership should our people decide to end the Treaty of Union (1707) with the rest of the UK and revert back to being an independent country again.

I would specificaly like to know whether the European Court Of Justice interprets current law to be that Scotland would remain a full EU member in it's own right.

The Court of Justice has no documents of the type you request and therefore is unable to provide you with such.

The Court of Justice cannot comment on issues of the type you raise in a general manner. The role of the Court is to provide judgments in cases brought before in accordance with the EU Treaties. I'm sure you understand that to comment outside the context of these cases could prejudice the work of the Court if such a matter were to be subsequently brought before it in the form of a case as the Court would have essentially prejudged the matter.
