I am filing the following confirmatory application with regards to my access to documents request 'Shein's risk assessment and user figures'.

I note that the Commission has withheld access to a total of 14 documents, all of which concern Shein's compliance with the Digital Services Act. The Commission has based its refusal on Article 4(1)(b), the first indent of Article 4(2), and the third indent of Article 4(2) of Regulation 1049/2001.

However, I note that the Commission has not referred to the general presumption of non-disclosure it has discovered for other, similar documents regarding ongoing DSA investigations. I would like to ask the Commission whether this means it has dropped this general presumption?

Also, I note that its blanket refusal of my requests appears to be based on such a general presumption, but without explicitly calling it that. For one, the Commission does not seem to have developed any arguments for why any of the individual documents would cause harm in disclosure, but rather has one argument covering all documents. Also, this argument does not seem to be overtly specific, except for arguing that disclosure could harm Shein's commercial interest, and subvert the purpose of the DSA investigation.

That, in my view, runs contrary to the requirement to properly justify non-disclosure on a case-to-case basis grounded on real and non-hypothetical reasons. I therefore ask the Commission to re-consider all the documents in question individually with a view towards whether they can be disclosed.

Also, I would like to argue for an overriding public interest in disclosure. Together with my colleague Yara van Heugten at Follow the Money, we have been investigating various issues around Shein's conduct over the past few months. This includes issues covered by the DSA, such as the alleged use of deceptive design, effective risk mitigation for counterfeit products on its platform and appropriate steps against unsafe products. Regardless of the outcome of the investigation, I consider it detrimental to the public interest if Shein's disclosures on these matters as part of its risk assessment should not be seen by the public. Furthermore, e-mail exchanges among the documents in question could shine further light on Shein's conduct, therefore allowing public assessment of Shein's compliance with legal obligations under European and national law. Non-disclosure hurts the right to make informed decisions by consumers, but also could impede investigations by consumer protection advocates and national authorities in the member states. These investigations, far from being hypothetical, are indeed conducted regularly. Failure to disclose the documents would therefore be detrimental to our further journalistic investigations, and impede public understanding.
