Subject: Your request for access to documents under Regulation (EC) 1049/2001
Dear Mr Roth,
On 23.01.2022, you sent an access to documents request to the European Data Protection
Supervisor (“EDPS”) based on Regulation (EC) No 1049/2001, which we registered on the
next day. On 26.01.2022, we sent you an acknowledgement of receipt for your request also
mentioning the deadline in accordance with Article 7(1) of Regulation (EC) 1049/2001. On
11.02.2022, the EDPS informed you that your current request will be handled in a queue
together with the five requests you had submitted on previous dates and will be answered
one after the other.
Your request for access to documents concerns documents relating to:
“Documents regarding the above mentioned "mapping" [as per EDPS order from
05.10.2020], received from the EUIs [European Union institutions, agencies and bodies].
"Transfer Impact Assessments", received from the EUIs.
c) "Joint Assessments", received from the EUIs.”.
On 11.03.2022, we sent you a Request for Clarification letter asking for “more detailed
information about the documents that you seek to obtain, such as references, dates or
periods during which the documents would have been produced, etc.” On 31.03.2022, you
replied that you “can only specify [our] request if [we] provide [you] with a list of the titles
of the documents”. By letter of 06.04.2022, we requested further clarifications. We did not
receive an answer to that request.
Our analysis showed that the 90 documents falling within the scope of your request (see
Annex I) belong to EDPS’ open investigation case 2020-0766 “EDPS strategy for the
enforcement of Schrems II judgement for EUIs”. We identified that all documents are the
same type (i.e. reports). Based on that, we concluded that the particular circumstances of
the individual case represent an exception to the EDPS’ obligation to examine specifically
and individually the documents to which access has been requested.1
Furthermore, we concluded that more than one of the exceptions of Article 4 of Regulation
(EC) 1049/2001 apply to all documents identified as explained hereafter.
First, the EDPS has determined that Article 4(1) (a), first indent, of Regulation (EC) 1049/2001
(“protection of the public interest as regards of public security”), applies to the documents
concerned as they contain description of (i) processes, (ii) security controls and (iii)
information security protocols, related to EUIs’ data and information exchange, the
disclosure of which may seriously threaten the day-to-day work and proper functioning of
the organisations2.
Furthermore, the EDPS has determined that Article 4(2) third indent, of Regulation (EC)
1049/2001 (“protection of the purpose of inspections, investigations and audits”) applies to
all documents identified as they are currently part of an open EDPS investigations, and thus
any disclosure of the documents at this stage of the investigation will serious undermine its
outcome.
In particular, disclosure at this point in time of the mapping exercises, Transfer Impact
Assessments or/and Joint Assessments conducted by EUIs, relating to the implementation
of the Schrems II judgment may endanger the completion of the exercise by hindering
cooperation on the part of the supervised European Institutions and bodies subject to it. We
note that the Court of Justice of the European Union has clarified that the concept of
"investigation" is likely to also cover the activity aimed at ascertaining facts in order to assess
a given situation3. In that context, the EDPS, using his investigatory powers may gather and
analyse information relating to the implementation of data protection requirements by the
supervised EUIs.
Finally, we have concluded that Article 4 (3) of Regulation (EC) 1049/2001 (“documents
related to matter where the decision has not been taken by the institution disclosure of
which would seriously undermine the institution's decision-making process”) of Regulation
(EC) 1049/2001 apply to all documents concerned as any disclosure of the documents at this
stage of the decision-making process will serious undermine the ability of the organisation
to conduct internal discussions and form an independent decision.
Following these conclusions, and in line with Regulation (EC) 1049/2001, we have examined
whether there could be an overriding public interest in disclosing the documents, but have
not been able to identify such an interest.
Therefore, we regret to inform you that we cannot provide you with access to the above-
referred requested documents.
