State aid cases - taxation

We're waiting for Henry Weston to read recent responses and update the status.

Dear Competition,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

The number of state aid investigations opened by the European Commission into the tax treatment of certain companies or individuals each year

Please provide the data for each of the last five years with a year-end 31st December, or whichever year-end is most convenient. If you cannot provide data for each of the last five years, then please provide data for each of the last three years. If that is not possible, then please provide data for each of the most recent two years.

Dear  Mr. Weston,

 

 

We refer to your e-mail on 15/03/2019  in which you make a request for “
The number of state aid investigations opened by the European Commission
into the tax treatment of certain companies or individuals each year”.

 

We inform you that DG COMPETITION can only provide information on cases
where a decision has already being adopted.

 

Those cases are public and you can perform a search by yourself on [3]DG
COMP website by aid instrument and select “tax advantage or tax
exemption”.

 

The [4]state aid transparency public search gives access to state aid
individual award data provided by Member States in compliance with the
European transparency requirements for state aid. Citizens and companies
can easily access information about awarded aid: name of the beneficiary,
amount, location, sector and objective.

The purpose of the transparency requirements is to promote accountability
of granting authorities and to reduce asymmetries on the market for state
aid. Complementary information on all authorised state aid in the EU,
including information in relation to the transparency requirement, can be
found in the [5]database of competition cases (ISEF registry of the
European Commission)

How many formal investigations has the European Commission decided to open following the receipt of a notification about the existence of tax exemption or tax advantage scheme?

Please provide the data for each year of the last five years with a year-end 31st December. If you cannot provide data for each of the last five years, then please provide data for each of the last three years. If that is not possible, then please provide data for each of the most recent two years.

you that you could find the answer on our search engine in the web page od
DG COMPETITION.

As you can see in the picture below, If you add “C” as “State aid
procedure” to the previous search criteria in the online search engine,
you get the requested result.
