Status of the Recast of DIRECTIVE 2011/92/EU OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 13 December 2011 on combating the sexual abuse and sexual exploitation of children and child pornography
Dear European Parliament,
My name is Summer Coleman and I am currently writing my bachelors thesis on how criminal liability for AI generated CSAM offending is allocated in the European Union. I am examining the Proposed Recast of Directive 2011/92/EU. I have been able to locate the European Parliament and Council’s position on the paper and their disagreements especially regarding article 5(10) and the idea of awarding Member State discretion for possession of CSAM for personal use. I am aware trilogue negotiations began in the middle of 2025. I am looking for some information about the status and changes of the Directive since then. Is there any information or updates? Additionally, Is there an earmark as to when this Directive may enter into force?
Many thanks in advance!
Summer Coleman
