We refer to your email below through which you introduce a new request for access to documents originating from third parties. As you know, the Legal Service is currently dealing with your request concerning case C-62/14 (reference GestDem 2018/4071), which constitutes the 2nd batch of your previous request of 22/05/2018 in accordance with the fair solution agreed upon on 24/05/2018. This request concerns 18 documents originating from third parties. The procedure of consultation, in conformity with Article 4(4) of Regulation 1049/2001, is still ongoing.
As already explained, the consultation procedure referred to above ads an additional administrative step to the handling of the requests. Furthermore, in view of the number and nature of other requests the Legal Service is currently dealing with, it will not be possible for us to provide you with the reply within the time limit set by Article7(2) of Regulation 1049/2001 regarding public access to documents.
In view of the above, we would like to propose to you to treat your request of 13 August 2018 below as part of the fair solution. In this way, once the reply to your request concerning C-62/14 has been sent, the Legal Service will register and communicate the deadline for dealing with your new request concerning joined cases C-8/15P and C-10/15P. This way, we will be able to conciliate your interest with the principle of good administration and without prejudice to other applicants' requests.

We just noticed that in our previous e-mail, registered under the
reference Ares(2018)6143960, the have forgotten to mention the new
extended deadline date.
This extended time limit is needed as your request concerns documents of
which the Commission is not the author and, according to Article 4(4) of
that Regulation the Commission has to consult the third party on the
disclosure of the document. This consultation procedure adds an additional
administrative step to the handling of your access request.
Moreover, following the judgment of the Court in Case C-213/15P Breyer,
the Commission has received a large number of access requests concerning a
very large total number of documents where third parties need to be
consulted.
Under these circumstances, we have to ask for an extended deadline in
conformity with Article 7(3) of that Regulation. The new deadline will
expire on 10.12.2018. We will inform you in due time in case the treatment
of your request could not be finalised before the expiration of the second
deadline.
