Council Regulation 2016/300 of 29 February 2016 determining the emoluments of EU high-level public office holders applies inter alia to the President of the European Council and the Secretary-General of the Council.

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

- If applicable, the period during which a monthly transitional allowance has been paid to former President of the European Council Donald Tusk since 30 November 2019

Dear Mr Teffer,

While examining your request, we have noticed that, by its nature, it
concerns documents containing personal data within the meaning of Article
3(1) of Regulation (EU) 2018/1725. Indeed, “total sum of monthly
transitional allowance” paid to an individual is information relating to
an identified natural person, and thus personal data.

Article 4(1)(b) of Regulation (EC) No 1049/2001 provides that “the
institutions shall refuse access to a document where disclosure would
undermine the protection of […] privacy and the integrity of the
individual, in particular in accordance with [EU] legislation regarding
the protection of personal data”.

The Court has clarified that this indivisible provision requires that any
undermining of privacy and the integrity of the individual must always be
examined and assessed in conformity with the legislation of the European
Union concerning the protection of personal data, in particular Regulation
(EU) 2018/1725[1]. Consequently, if an application for access to documents
may, if granted, result in the disclosure of personal data, the
institution in receipt of the application must apply all the provisions of
Regulation (EU) 2018/1725.[2]

 

Regulation (EU) 2018/1725 provides that personal data may be transmitted
to recipients established in the Union other than Union institutions and
bodies only if whoever requests such a transmission first establishes that
it is necessary to have the data transmitted for a specific purpose in the
public interest (Article 9(1)(b)).

Given that the transmission of personal data in the context of a public
access request requires, as a precondition, the demonstration of its
necessity for a specific purpose in the public interest, by derogation to
the principle underlying Article 6(1) of Regulation (EC) 1049/2001,
pursuant to which there is no obligation of motivating an application
(Judgment of the General Court of 6 April 2022 in Case T-506/21,
Hans-Wilhelm Saure v European Commission, paragraphs 25-26), you are
kindly requested to provide us with express and legitimate arguments that
would justify the necessity of having said personal data transmitted to
you.

Dear Madam, Sir,

I refer to my request for access to documents registered under 23/0312-PRO-el, and your request from 27 February 2023 to demonstrate the necessity of the transmission of personal data for a specific purpose in the public interest.

I acknowledge that the requested documents may contain personal data, but I believe there is a necessity in transmission in the public interest.

The monthly transitional allowance for former Presidents and Secretaries-General of the Council has a specific purpose, as explained in recital 6 of Council Regulation (EU) 2016/300. "[T]he purpose of the transitional allowance for public office holders is to ensure, for a limited period directly following their term of office, a certain level of financial security until their next paid employment with a similar level of remuneration, or other source of income such as their pension."

The public, more specifically the citizens of the EU, have an interest that the money from the EU budget is properly spent. It is in their interest that an investigative journalist like myself can assess whether the period during which former EU public office holders receive transitional allowances is appropriate and not continued when these former public office holders have new "paid employment with a similar level of remuneration".

It has happened in the past that former public office holders did not fully comply with the applicable rules, which is why it is legitimate for journalists to check if the former President and former Secretary-General have complied. A study commissioned by the European Parliament (Transitional allowances for former EU office holders – too few conditions?, 2017) noted the monitoring in place was not perfect: "Experience with the implementation of the regulatory framework suggests room for improvement with regard to monitoring, since there have been issues over the accuracy of information provided by former office holders." This suggests that press investigations into proper monitoring might benefit society.

I hope this sufficiently demonstrates why it is necessary for a specific purpose in the public interest that the requested personal data is provided.
