I am filing the following confirmatory application with regards to my access to documents request 'Transparency Register - SI (2018) 410'.

Thank you for your reply to my request for access to documents reference number GESTDEM
2018/5149. I would herewith like to submit a confirmatory application.

You argue that complete and partial disclosure is prevented by Article 4 (3) of Regulation No 1049/2001 as :
« Disclosure of the document requested would seriously undermine tghe protection of the decision-making process of the European Commission, as it would reveal the European Commission’s internal assessment of the respective negotiating positions of the other two institutions in the ongoing interinstitutional negotiations on a mandatory Transparency Register »

This argumentation is at odds with Regulation 1049/2001 for the following reasons:
When using the exception article 4.3 on protecting the decision-making process, the institution must prove that an exception “may be justified only if access to that document could specifically and effectively undermine the protected interest. Moreover, the risk of the protected interest being undermined must not be purely hypothetical and must be reasonably foreseeable.” (Case C‑280/11 P, Access Info vs. Council).

This was not the case in your reply.

I would also like to reiterate that there is an overwhelming public interest in disclosure of these documents as these relate to the Commission’s position on the reform of the EU Transparency Register, a position that was agreed in College of Commissioners but its content is not public.

There is a widespread interest in the issue of lobby transparency across the EU as it speaks directly to the accountability and scrutiny of policy-makers’ interactions with vested interests. This documents seems to be the current Commission position in the negotiations for an Inter-Institutional Agreement which is a fairly non-transparent process itself.

We notice as well that similar documents containing assessments on the negotiations have been released by the European Parliament, which would make it unacceptable for the Commission to not match that standard of transparency.

There is a pressing and obvious need to be transparent about discussions on lobby transparency.

I also refer to our holding reply of 29 October 2018, by which the time
limit for replying to your confirmatory application was extended by 15
working days, pursuant to Article 8(2) of the Regulation. This extended
time limit expires on 27 November 2018.

I regret to have to inform you that we will not be able to respond within
the extended time-limit, as we have not yet finalised internal
consultations. I can assure you that we are doing our utmost to provide
you with a final reply as soon as possible.

I regret this additional delay and sincerely apologise for any
inconvenience this may cause.
