Travel expenses for officials paid for by non-EU governments, organisations (DG NEAR)
Dear Neighbourhood and Enlargement Negotiations,
Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents that contain the following information:
- The number of officials within DG NEAR who accepted third party contributions for their missions that were not provided by EU Member States, EEA and EFTA countries, international organisations or fora, such as the UN, G20/G7, or public and private universities when the mission was for academic purposes between January 1, 2022, and December 31, 2022.
- All minutes, agendas, summary, correspondence, memos and any other reports drafted and received by DG NEAR between January 1, 2022, and December 31, 2022, relating to the above missions.

Dear Ms Diehn,
We are writing concerning your request for access to Commission documents
registered on 10 July 2023 with reference number EASE 2023/4017.
Although you state at the very beginning that your request is under
Regulation (EC) 1049/2001, in your first point you ask for "...the number
of officials within DG NEAR who accepted third party contributions for
their missions...". We are of the opinion that this segment of your
request would be better dealt with as a request for information and could
be transferred to the relevant department of DG NEAR.
The main difference is that in a request for information, which is handled
by the unit in DG NEAR responsible for the concrete program/project you
are asking for, Colleagues can reply and provide concrete information to
your query. A request for information will be handled under the [1]Code of
Good Administrative Behaviour.
On the other hand, in a request for access to documents under the
Regulation 1049/2001, DG NEAR will not provide concrete information but
will share documents, if they exist, that may match what you are asking
for. Please note that the Regulation 1049/2001 concerns only to documents
in possession of the Commission and does not require us to create new
documents in order to meet a given request, not even by compiling
information from other existing documents.
We would be grateful if you could inform us if you agree with our
suggested course of action as soon as possible and in any case within five
working days upon receipt of this letter.

Hello,
We are writing concerning your request for access to Commission documents
registered on 10 July 2023 under case number EASE 2023/4017.
We are currently working on your request. However, we will not be able to
send you the reply within the prescribed time limit expiring on 31 July
2023, due to internal consultations.
Therefore, in line with Article 7(3) of [1]Regulation (EC) No 1049/2001,
we need to extend this time limit by 15 additional working days. The new
time limit expires on 22 August 2023.
