TTE Council (Working party) on internal markets in renewable and natural gases and in hydrogen framework

Dear Council of the European Union,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

– COM(2021) 803: Proposal for a Directive on common rules for the internal markets in renewable and natural gases and in hydrogen (recast) (interinstitutional file 2021/0425(COD)), and
– COM(2021) 804: Proposal for a Regulation on the internal markets for renewable and natural gases and for hydrogen (recast) (interinstitutional file 2021/0424(COD)),
up to and including the General Approach adopted by the TTE (Energy) Council on 28 March 2023.

In particular, I request access to:

Outcome of proceedings of the Council Working Party on Energy concerning COM(2021) 803 and COM(2021) 804, drawn up between 1 July 2022 and 28 March 2023.

Outcome of proceedings of Coreper (Coreper I) relating to these proposals in the same period, including documents recording the state of play and delegations’ scrutiny reservations prior to the General Approach.

All Presidency compromise texts and draft revisions of the Directive and Regulation circulated to delegations in the period 1 September 2022 – 28 March 2023, including any such texts transmitted as “WK” or “LIMITE” documents, notably the revisions preceding:
– the progress report to TTE in December 2022, and
– the General Approach text tabled for adoption at the TTE (Energy) Council of 28 March 2023.

All written comments from Member State delegations submitted to the Council or the Presidency on these compromise texts in the same period (July 2022 – March 2023), including comments reacting to:
– the progress report presented to TTE on 19 December 2022, and
– the texts forming the basis for the General Approach adopted on 28 March 2023.

Any room documents prepared by the Presidency for the TTE (Energy) Council meetings of 25 October 2022, 19 December 2022 and 28 March 2023 on COM(2021) 803 and COM(2021) 804.

Any lists or tables of national parliamentary/scrutiny reservations relating to these proposals that were presented to or updated for the TTE (Energy) Council on 28 March 2023.

If some of the requested documents originate from Member State delegations, I nevertheless request that the Council process this application in accordance with Article 5 of Regulation (EC) No 1049/2001 and consult the originating authorities as appropriate.
