Voluntary Pension Fund beneficaries

The request was refused by European Parliament.

Dear European Parliament,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

1. The names of all the MEPs who have signed up to and benefit from the European Parliament's voluntary pension scheme.

2. The fund invests in numerous sectors like equities, bonds and real estate. I would like a current detailed breakdown of those investments and their related sectors.

Yours faithfully,

Nikolaj Nielsen

Our Ref. A(2018)1971

Dear Mr Nielsen,

In reply to your request, Parliament would like to inform you of the following:

1. In its judgement of November 2011, The European Court of Justice has ruled that disclosing the names (personal data) would undermine the protection of privacy and integrity of MEPs who are or have been members of the additional pension scheme, cf. Judgment of the General Court in Case T-82/09: http://curia.europa.eu/juris/liste.jsf?l....

In a second case, introduced by the same applicant, the Court ruled that MEPs who were members of the voluntary pension scheme and who had voted on certain decisions related the scheme might have a potential conflict of interest and that their names should therefore be made public, cf. Judgement of the General Court in case T-115/2013: http://curia.europa.eu/juris/liste.jsf?n....

On this basis, the European Parliament made public the following documents [members of the voluntary pension scheme are marked in yellow]:
Results of the roll call vote (RCV) - Report Staes - Discharge EP 2005: http://www.europarl.europa.eu/RegData/pu...
Results of the roll call vote (RCV) - Report Pomés - Ruiz - Discharge EP 2006: http://www.europarl.europa.eu/RegData/pu...
Results of the roll call vote (RCV) - Report Liberadzki - Discharge EP 2010: http://www.europarl.europa.eu/RegData/pu...

2. No specific documents held by the European Parliament have been identified, containing the information you request. In this respect we draw your attention to the fact that the "Pension fund for Members of the European Parliament" is a legal entity separate from the European Parliament (ASBL registered under Luxembourgish law). The following documents might be relevant to your research:
Annual report (2016): http://www.europarl.europa.eu/RegData/pu...
Audit report (2016): http://www.europarl.europa.eu/RegData/pu...

On this basis, Parliament considers your request as handled and the file closed. Please do not hesitate to come back to us, should you have any new request for specific Parliament documents.

Sincere regards
